Satış ve Nakliye Koşulları
The following conditions apply to all commercial transactions taking place within CER-PA Norm. All agreements concerning sales and prices have to be written down. No verbal agreement is valid. Any order given CER-PA Norm is regarded as the acceptance of all these conditions.
Prices
The prices, referred in our current price list, are based on the existing production costs and applied for the term of a valid price list. The prices list is occasionally updated depending on increases in general production costs. Unless certain prices are determined and agreed on, CER-PA Norm reserves the right to alter the prices at the time of delivery due the increases in general production costs. An order can not be considered as valid until it is endorsed by our written confirmation. The same applies to add-ons and alterations in any confirmed order.
Customized Production (Special Production)
Special production with special sizes, models and markings is manufactured by CER-PA Norm. The minimum quantity for such an order is about 10.000 units. Yet, CER-PA Norm reserves the right to deliver and invoice + / - 10 percent in terms of quantity for such order. Such an order can not be cancelled once it is issued and confirmed. If such production is carried out in accordance with customer’s specifications, drawings and samples, it is the customer’s responsibilitiy to ensure their accuracy.
Delivery
The value of minimum orders is net EUR 2.500. For an order less than this amount; EUR 100 handling charge is required. The delivery form has to be ex-work our plant for orders between EUR 2.500-5000. The delivery term has to be FOB Istanbul for net orders over EUR 5.000. If any of the following C&F, CIF or CPT deliveries is demanded the transportation cost will be determined according to the amount of the order and charged.
Term of Delivery
Unless a certain period or a date is clearly specified, an approximate period or date is usually set for delivery term. If any alteration in and addition to a confirmed order is made, an extra time may be required. CER-PA Norm reserves to make partial delivery, unless otherwise is specified.
Payment
All commercial transactions and sales within our firm are conducted according to CER-PA Norm general sale conditions, unless otherwise is specified by a special agreement. In sales by installment, if a payment is made after due date, customer may be requested to clear the balance immediately. In such a case, a processed order may not be released or a new order may not be processed unless the overdue payment is promptly made. CER-PA Norm reserves the right to cancel orders in case of serious misgivings about a customer’s ability and willingness to pay.
Ownership of Goods
Unless payment is fully made for the purchase of particular order, the property ownership and rights will not be transferred to the custumer.
Guarantee
All products manufactured by CER-PA Norm has full guarantee. If a product is unusable due to defects, caused by deficiencies in workmanship and material,it will be replaced free of charge.If a product is returned due to damage, it will be tested by our quality control department. The guarantee may be void, if the product is misused, altered in its sizes and worn-out due to normal usage.
All sorts of complaints about our products should be made within two weeks of their purchase. Complaints about inconspicuous defects should be made immediately after the detection of such a defect. Complaint about damage occured during the transportation should be claimed from the freight company.
Returns
Returns are possible on the conditions that 80 percent of the original value will be reimbursed or credited to costumer’s accont and purchased product are retuned in exact quantity and in perfect condition. Cost of possible re-work may also be deducted from the reimbursed sum.
Place of Performance and Junisdiction
Place of performance and payment is Istanbul. In case of any dispute or disagreement, ‹stanbul Ticaret Mahkemeleri has full competency.
